Today at 2:00 PM ET, attorneys of the law firm of Faegre Drinker will provide an overview of the U.S. Supreme Court case Monsanto v. Durnell and its potential implications to stakeholders in the agricultural pesticides industry. The webinar is being hosted by the Agricultural Retailers Association, which NAAA joined last month in filing an amicus curiae, or “friend of the court” brief, that provides legal and detrimental production implications and impacts that would hit agricultural applicators nationwide should SCOTUS rule against Monsanto. The ARA/NAAA amicus, and Bayer attorneys—the manufacturers of glyphosate under the Roundup brand—argue that state Roundup herbicide lawsuits decided against the company for not carrying a warning that it may cause cancer are unlawful under federal law, where the EPA has concluded the product doesn’t pose a risk when used according to its label. This case matters because it could influence future litigation risk, product labeling obligations, and the type of liability claims that may be brought against companies throughout the agricultural supply chain. Oral arguments were held before the Supreme Court yesterday, and this webinar will cover the key legal issues, notable points from the Justices’ questioning, and what the case could mean going forward.
